1. About Surprisingly

Surprisingly is a Gift as a Service. We are not simply an online store where you select an individual product from a catalogue.

We take information about your occasion, recipient, preferences and selected budget and use it to curate, prepare and deliver a surprise gifting experience. Our objective is to make the experience special for both the sender and the recipient.

2. The Surprisingly Experience

When placing an order, you may provide information including occasion, recipient information, recipient preferences, relationship with the recipient, budget, interests, and other information relevant to the surprise.

Our team uses this information to curate an appropriate gifting experience. Because the service is intentionally personalised, the exact contents of a surprise may not be disclosed in advance and may vary from one order to another.

3. Our Value Promise

We curate every Surprisingly experience with your selected budget in mind. We make reasonable efforts to ensure that the value of the items and the overall gifting experience appropriately reflects the amount paid.

You are not simply paying for an individual product. You are paying for: Curation + Preparation + Packaging + Presentation + Delivery + The Surprise Experience.

Our promise is simple: you choose the occasion and the budget, we create the surprise. And hopefully, you get something even more valuable — a smile from someone you care about.

4. The Surprise Principle

The heart of Surprisingly is the element of surprise. The sender may not know exactly what will be included, and the recipient may not know what is coming. Therefore:

Exact contents may not be disclosed before delivery.
Items are selected based on the information provided.
The final presentation may differ from examples shown on the website.
Brand, colour, design or item variations may differ depending on availability.
Equivalent or suitable substitutions may be made where necessary.

5. Exceptional Disclosure of the Surprise

Keeping the surprise confidential is part of the Surprisingly experience. In exceptional circumstances, a sender may request to see the prepared hamper/surprise before delivery. At our discretion, we may allow this upon specific customer request. This is intended to be a rare exception and not a standard feature of the service.

6. Product/Item Availability

Although we curate the experience, certain items may become unavailable due to stock availability, supplier availability, location, seasonality, market availability, or other circumstances outside our reasonable control.

Where necessary, we may substitute an item with another item of comparable value and suitability. We will make reasonable efforts to maintain the intended quality and experience.

7. Delivery

Surprisingly arranges delivery for eligible orders. The customer is responsible for providing accurate and complete delivery information.

Delivery timelines may vary based on location, order preparation, availability, delivery partner, weather, public holidays, local restrictions, and unforeseen circumstances.

8. Recipient Availability

The sender is responsible for providing a suitable delivery address and relevant recipient information. If the recipient is unavailable, unreachable or unable to accept the surprise, we may attempt to coordinate another delivery attempt where reasonably possible. We will make reasonable efforts to preserve the surprise while coordinating delivery.

9. Cancellation

Because each surprise may involve personalised curation, procurement, preparation and packaging, cancellation may not always be possible once the process has started.

If cancellation is requested before the preparation/procurement process begins, we will review the request and, where reasonably possible, process the cancellation according to our Cancellation, Refund & Return Policy. Once preparation has started, cancellation may be restricted because costs may already have been incurred.

10. Failed Delivery / Recipient Unavailability

If a surprise cannot be delivered because the recipient is unavailable or delivery cannot reasonably be completed, we may attempt another delivery. If delivery ultimately cannot be completed, we may provide account credit or a coupon of equivalent eligible value, subject to the circumstances of the order. This allows the customer to use the value toward another Surprisingly experience.

11. Customer Responsibilities

The customer agrees to provide accurate information, including sender information, recipient information, delivery address, contact information, occasion details, preferences, and other information used for curation.

Surprisingly is not responsible for problems caused by incorrect or incomplete information supplied by the customer.

12. Prohibited Use

You must not use Surprisingly for illegal activities, harassment, threatening or abusive communications, fraudulent activity, delivery of prohibited or unlawful materials, or activities intended to harm another person.

We reserve the right to refuse or cancel an order where we reasonably believe the service is being misused.

13. Intellectual Property

The Surprisingly name, logo, website design, content, graphics, photographs, text, branding and other materials are owned by or licensed to Surprisingly. They may not be copied, reproduced, modified or commercially used without appropriate permission.

14. Limitation of Liability

We will make reasonable efforts to provide the gifting experience described on our website. However, we are not responsible for delays, interruptions or failures caused by circumstances outside our reasonable control, including certain natural events, weather conditions, transportation disruptions, strikes, public disturbances, technical failures, and third-party service interruptions.

Nothing in these Terms is intended to exclude or limit any consumer right or liability that cannot lawfully be excluded or limited.

15. Changes to These Terms

We may update these Terms from time to time. The latest version will be published on this page.

16. Governing Law

These Terms shall be governed by the applicable laws of India. Any dispute shall be subject to the applicable courts and consumer dispute mechanisms having jurisdiction under applicable law.
